This page sets forth the complete terms and conditions that apply to participate in the East Coast Car Rentals Sponsorship Partner program.
1. Joining the Sponsorship Program
East Coast Car Rentals Sponsorship Program approves quality organisation’s. Approval will be solely at the discretion of East Coast Car Rentals.
To join the Sponsorship Program, you must apply by completing the Online Application Form. Please take a moment to read and agree to all of the terms and conditions contained on this page.
Once your application has been approved, an email confirmation will be sent with your unique ECP Code (East Coast Promotional Code) details and links to various banners and artwork as well as acceptance of your application to join our Sponsorship Program. This e-mail will also contain a login for you to access our reservations system so you can monitor donation payments.
East Coast Car Rentals reserves the right to reject any application if we determine that the organisation’s of their websites promote or feature content that may offend or be deemed inappropriate. This includes, but is not limited to sites that:
- promote sexually explicit or adult orientated materials, including dating services
- promote violence
- promote cruelty or abuse of animals
- promote discrimination based on race, sex, religion, nationality, disability, sexual orientation, or age
- promote illegal services or material, including email or internet spamming and hacker practices
2. Your Obligations
As a participant in our Sponsorship Program, you agree to actively promote the East Coast Car Rentals brand through the placement of the supplied East Coast Car Rentals banners’ on your web site and other member communication formats (ie. newsletters). This may include (but not limited to) promotional text, business listing or profile, images, banner ads and ticket sales promotion.
You will be solely responsible for the development, operation and maintenance of your site as well as for all materials appearing on it. Your responsibilities include without limitation all aspects of the technical operation of your site (including the proper formatting of links so as to permit tracking of sales) and ensuring that the content of your site does not violate or infringe the rights of any third party. East Coast Car Rentals disclaims all liability for these matters and you shall indemnify and hold harmless East Coast Car Rentals from and against all damages, claims and expenses relating to them.
3. East Coast Car Rentals Obligations to its Partners
East Coast Car Rentals will handle all enquiries and customer related services, including confirmation of Rental Reservations. Customers will click on the links from your site, and be redirected to the East Coast Car Rentals site, or book direct with us using your unique ECP Code, where East Coast Car Rentals will be responsible for tracking all sales that come from your referral. You will receive a donation (which may includes GST) for each successfully completed Rental. No credit will be given for cancelled bookings or unsuccessfully completed reservation. Donation payments will be paid directly into the bank account you nominate the your application.
Donation payments will be made within 14 days of the close of every calendar month. A recipient created invoice will be issued summarizing sales and donations payable for the period. A detailed sales and donation report will be made available online via personal login as part of the program.
4. Duration of the Program
The term of this Program will commence upon East Coast Car Rentals acceptance of your application and will continue until terminated. Subject to point 5 below, either party may terminate this Agreement at any time by giving at least 30 days written notice, which may be given by e-mail, to the other party. Donation payments to you in respect to customers who may follow links from your site to rent cars after this Agreement is terminated, will not be payable, however outstanding donations for future reservations that materialise will be maintained.
5. Modification
East Coast Car Rentals shall have the right at any time to change or modify the terms and conditions of this Program or to impose new conditions. Such changes, modifications or additions shall be effective immediately upon notice thereof, which may be given by any means including by posting on the site. The absence of notice of termination, which will be effective immediately, by you will constitute your binding acceptance of the change, modification or addition.
6. Relationship of Parties
You and East Coast Car Rentals are independent contractors, and nothing in this Program shall be deemed to create any partnership, joint venture, agency, franchise, sales representative, or employment relationship between us. You do not have the right to accept any offers on behalf of East Coast Car Rentals or to act for or bind East Coast Car Rentals in any manner and you shall not make any statement, whether or not on your site, to indicate otherwise.
7. Limitation of Liability
In no event will East Coast Car Rentals be liable for any indirect, special, or consequential damages arising in connection with this Program, your role as a Partner or any item sold under this Program.
8. Disclaimers
Other than as required by law, East Coast Car Rentals make no express or implied warranties or representations with respect to any item sold pursuant to this Program or with respect to the operation of the East Coast Car Rentals site.
9. Content
You acknowledge that the East Coast Car Rentals site contains information, data, graphics and other material protected by copyrights and trademarks and that these rights are valid and protected in all forms, media and technologies existing now or hereinafter developed. Use of our brand, logo, name or image in anyway must first be approved by East Coast Car Rentals.
